These Terms & Conditions ("Terms") govern your use of the client communication and appointment services provided by Perpetual Studio ("we," "us," or "our"), operated by Lucas Cummins, on behalf of participating tattoo studios. By providing your information, consenting to receive messages, or otherwise using the service, you agree to these Terms.

SMS Messaging Program

Program name: Perpetual Studio Client Messaging

Program description: Perpetual Studio sends appointment and consultation text messages on behalf of participating tattoo studios to clients who have requested to be contacted. Messages include booking confirmations, appointment reminders, scheduling updates, and replies to client questions about their tattoo consultation or appointment.

How you opt in

You opt in by submitting a booking or consultation inquiry through a participating tattoo studio's online intake form and checking the clearly labeled box consenting to receive SMS messages about your appointment. You are not enrolled unless you submit that form and provide consent. Consent is recorded for each client.

Program details:

Message types: appointment confirmations, appointment reminders, scheduling updates, and consultation replies.
Message frequency: message frequency may vary based on your interaction with the studio. You will typically receive up to 10 messages per month.
Message and data rates may apply based on your mobile carrier plan.
To opt out: reply STOP at any time to cancel. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent.

Carriers are not liable for delayed or undelivered messages.

Consent

Consent to receive SMS messages is not a condition of any purchase. You may opt out at any time by replying STOP. After opting out, you may receive a single confirmation message.

No sharing of your mobile information: No mobile information, phone numbers, or SMS consent obtained from you will be sold, rented, or shared with any third parties or affiliates for their own marketing or promotional purposes. Consent to receive SMS messages is never shared with third parties for marketing. Information is shared only with the tattoo studio you are communicating with, and with service providers strictly for the purpose of delivering messages and operating the platform.

Use of the Service

You agree to provide accurate information and to use the service only for lawful purposes related to booking and communicating with a tattoo studio. You agree not to misuse, disrupt, or attempt to gain unauthorized access to the service.

Appointments & Deposits

Booking, deposit, cancellation, and rescheduling terms are set by the individual tattoo studio you are working with. Perpetual Studio provides the communication platform but is not a party to the agreement between you and the studio regarding services rendered.

No Warranty

The service is provided "as is" without warranties of any kind. We do not guarantee that messages will be delivered without delay or error, as delivery depends on your mobile carrier and other factors outside our control.

Limitation of Liability

To the fullest extent permitted by law, Perpetual Studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service or the SMS messaging program.

Privacy

Your use of the service is also governed by our Privacy Policy, which describes how we collect and handle your information.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent changes. Continued use of the service after changes constitutes acceptance of the revised Terms.
